This information sets out and regulates the conditions of use, the limitations of responsibility and the obligations that users of the website published under the domain name www.icong.org assume and undertake to respect.
Definitions
‘Site’ , means the domain www.icong.org that is made available to Internet Users.
‘User’ , means a natural or legal person who uses or requests an electronic communications service available to the public. (Definition in the European Electronic Communications Code)
‘End User’, means a user who does not provide public communications networks or electronic communications services available to the public. (Definition in the European Electronic Communications Code)
‘Content’, means the pages that make up the entire domain www.icong.org which make up the information and services that ICONG makes available to Internet Users. They contain the messages, texts, photographs, graphics, icons, logos, technology, links, textures, drawings, sound and/or image files, recordings, software, appearance, graphic design and source codes and, in general, any kind of material contained in the Site.
‘Web’, technical word that describes the system of access to information via Internet, which is configured by means of pages made with HTML or similar language, and programming mechanisms such as java, javascript, PHP, or others, etc. These pages designed and published under a domain name are the result of the information that the owner makes available to Internet Users.
‘Electronic communications service’ , means an electronic communications service generally provided for remuneration over electronic communications networks (definition in the European Electronic Communications Code)
‘Internet access service’, means a publicly available electronic communications service providing access to the Internet and hence connectivity between virtually all end points connected to the Internet, irrespective of the network technology and terminal equipment used (definition in the Regulation on measures regarding access to an open Internet) ‘Hyperlink’ means a technique by which a User can browse different web pages, or the Internet, by simply clicking on a link on the Internet). (Definition given in the Regulation on measures in relation to access to an open internet)
‘Hyperlink’ , means a technique by which a User can navigate to different pages of the Web, or the Internet, by simply clicking on the text, icon, button or code contained in the link.
‘Cookies’, technical means for the ‘traceability’ and monitoring of browsing on websites. These are small text files that are written on the User’s computer. This method has implications for privacy, so ICONG will give appropriate and reliable notice of their use when they are implemented on the Site.
‘Terminal equipment’ , means equipment connected directly or indirectly to the interface of a public telecommunications network for the purpose of transmitting, processing or receiving information (as defined in Directive 2008/63 on competition in the markets for telecommunications terminal equipment).
Conditions of use
The simple and mere use of the Site grants the condition of user of the Site, whether a natural or legal person, and obligatorily implies the complete, full and unreserved acceptance of each and every one of the clauses and general conditions included in the Legal Notice. If the end User does not agree with the clauses and conditions of use of this Legal Notice, he/she shall refrain from using the Site.

Through the Site, ICONG provides End Users with access to and use of various Contents published on the Internet by ICONG or by authorised third parties.
The End User is obliged and undertakes to use the Website and the Contents in accordance with current legislation, the Legal Notice, and any other notice or instructions made known to him/her, either by means of this legal notice or in any other place within the Contents that make up the Website, as well as with the rules of coexistence, morality and generally accepted good customs.

Intellectual property
All trademarks, trade names or distinctive signs of any kind that appear on the Site are the property of ICONG or, where appropriate, of third parties who have authorised their use, and it may not be understood that the use of or access to the Portal and/or the Contents attributes to the User any right over the aforementioned trademarks, trade names and/or distinctive signs, and it may not be understood that any of the exploitation rights that exist or may exist over said Contents have been transferred to the User.
Likewise, the Contents are the intellectual property of ICONG, or of third parties where appropriate, and therefore the Intellectual Property rights are the property of ICONG or of third parties who have authorised their use, who have exclusive rights to exploit them in any way and, in particular, the rights of reproduction, distribution, public communication and transformation.
The unauthorised use of the information contained on this website, as well as any breach of the intellectual or industrial property rights of ICONG or of third parties included on the website who have provided content, shall give rise to the legally established responsibilities.

Availability of the Site
ICONG does not guarantee the non-existence of interruptions or errors in access to the Site, its Contents, nor that it is up to date, although it will make its best efforts to avoid, correct or update them, as the case may be. Consequently, ICONG shall not be liable for damages of any kind caused to the End User as a result of faults or disconnections in the telecommunications networks that lead to the suspension, cancellation or interruption of the Portal service during or prior to the provision of the same.
ICONG excludes, with the exceptions contemplated in the legislation in force, any liability for damages of any kind that may be due to the lack of availability, continuity or quality of the operation of the Site and the Contents, to the non-fulfillment of the expectation of usefulness that users may have attributed to the Site and the Contents.

Jurisdiction
For any questions that may arise regarding the interpretation, application and compliance with this Legal Notice, as well as any claims that may arise from its use, all intervening parties submit to the Judges and Courts of the city of Madrid, expressly waiving any other jurisdiction that may correspond to them.
